This study aims to analyze the concept of ittihad al-majlis in marriage
contracts according to the Shafi'i and Hanafi schools of Islamic jurisprudence and its
relevance to online marriage practices. This research employs a qualitative library
research method through the analysis of classical and contemporary fiqh literature,
scientific journals, and other supporting documents. The data were analyzed using
descriptive, comparative, and interpretative approaches.
The findings reveal that the Shafi'i school interprets ittihad al-majlis as the
physical unity of place and time, requiring the marriage contract to be conducted
within the same assembly. In contrast, the Hanafi school understands ittihad al-majlis
as the continuity of ijab (offer) and qabul (acceptance) within an uninterrupted
communication process, even when the parties are located in different places.
Therefore, the Hanafi perspective is considered more relevant to online marriage
practices, provided that the pillars and legal requirements of marriage are fully
fulfilled.
