Hukum Islam (Studi Analisis M. Quraish Shihab).
Penelitian ini mengkaji tentang kepemimpinan perempuan dalam perspektif
hukum Islam dengan menganalisis pandangan M. Quraish Shihab. Lebih rincinya
yaitu membahas tentang kebolehan kaum perempuan untuk memimpin dalam
pandangan Islam. Penelitian ini bertujuan untuk menganalisis bagaimana
pandangan dalam perspektif hukum Islam mengenai kepemimpinan perempuan
menurut Quraish Shihab. Penelitian ini menggunakan metode deskriptif kualitatif,
yaitu mendeskripsikan pandangan Quraish Shihab dalam perspektif hukum Islam.
Hasil dari penelitian ini yaitu, Quraish Shihab mempunyai pandangan tersendiri
mengenai perempuan. Perempuan menurutnya mempunyai hak yang sama dengan
laki-laki termasuk dalam hal kepemimpinan, namun dalam perspektif ulama
klasik mengharamkan perempuan untuk menjadi pemimpin dalam hal apapun,
sedangkan menurut Quraish Shihab yang mengacu terhadap pemikiran ulama
moderat, mempunyai pandangan akan kebolehan kepemimpinan perempuan
diruang publik dengan syarat tidak meninggalkan kewajiban pokoknya untuk
melayani suami dan mengasuh serta mendidik anak-anaknya. Perbedaan pendapat
ini terjadi karena situasi dan kondisi zaman yang berbeda, sehingga berpengaruh
terhadap hasil penafsiran para ulama dalam konteks al-Qur’an. Sedangkan hukum
islam itu bersifat universal, bisa berlaku kapan saja disesuaikan dengan kondisi
dan budaya yang terjadi saat ini, melalui hasil pemikiran para ulama yang ahli
dibidang hukum islam. Dengan hasil ijtihad para jumhur ulama disetiap zaman
atau para ulama moderat, maka muncul ayat-ayat dalam perspektif hukum islam
yang disesuaikan dengan kondisi zaman yang terjadi saat itu dengan tetap
berlandaskan kepada al-Qur’an, Hadist, dan Qiyas.

Islamic Law (Analysis Study of M. Quraish Shihab)
This study examines women's leadership in the perspective of Islamic law by analyzing
the views of M. Quraish Shihab. In more detail, it discusses the permissibility of women
to lead in the view of Islam. This study aims to analyze how the views in the perspective
of Islamic Law regarding womens leadership according to Quraish Shihab. This study
uses a qualitative descriptive method, which describes the views of Quraish Shihab in the
perspective of Islamic law. The results of this study are, Quraish Shihab has his own view
about women. According to him, women have the same rights as men, including in terms
of leadership, but in the perspective of classical scholars it is forbidden for women to be
leaders in any case, while according to Quraish Shihab, who refers to the thoughts of
moderate scholars, has a view of the permissibility of women's leadership in the public
sphere on condition that does not leave her main obligation to serve her husband and to
care for and educate her children. This difference of opinion occurs because the situation
and conditions of the times are different, so that it affects the interpretation of the
scholars in the context of the Qur'an. While Islamic law is universal, it can apply at any
time according to the current conditions and culture, through the thoughts of scholars
who are experts in Islamic law. With the results of the ijtihad the jumhur of scholars in
every era or moderate scholars, then the verses in the perspective of islamic law appear
that are adapted to the conditions of the times that occurred at that time while still being
based on the Qur’an, hadith, and qiyas.
